2. Description of Service

NeonSnap provides an AI-powered platform that allows users to transform and edit photos, including but not limited to:

• Hair Transformation: Change hairstyles, colors, and lengths
• Makeup Studio: Apply virtual makeup and cosmetic enhancements
• Outfit Changer: Modify clothing styles and colors
• Background Editor: Replace or modify photo backgrounds
• Expression Adjuster: Modify facial expressions and emotions

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Account Registration and Security

3.1 Account Creation

• You must be at least 13 years old (or 16 in some jurisdictions) to create an account
• You must provide accurate, complete, and current information
• You are responsible for maintaining the confidentiality of your account credentials
• You may not share your account with others or create multiple accounts

• You are responsible for all activities that occur under your account

4. Subscription and Payments

NeonSnap offers both free and paid subscription plans. Paid plans provide access to premium features, higher processing limits, and priority support.

4.2 Billing and Payments

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law or stated in our Refund Policy
• You authorize us to charge your payment method for all applicable fees
• Prices may change with 30 days' notice for existing subscribers

4.3 Automatic Renewal

• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel your subscription at any time from your account settings
• Cancellations take effect at the end of the current billing period

4.4 Free Trials

• You must provide payment information to start a free trial
• You will be charged unless you cancel before the trial ends

5. Acceptable Use Policy

The Service, including its design, features, technology, and content (excluding User Content), is owned by NeonSnap and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer or attempt to extract source code
• Remove or alter copyright notices or proprietary marks
• Use our trademarks or branding without written permission

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes, subject to these Terms.

7. User Content and Ownership

7.1 Your Content

You retain all ownership rights to the photos and images you upload to NeonSnap ("User Content"). By uploading User Content, you represent and warrant that:

• You own the Content or have necessary rights to use it
• The Content does not violate any third-party rights
• The Content complies with these Terms and applicable laws
• You have consent from any individuals depicted in the Content

7.2 License to NeonSnap

By uploading User Content, you grant NeonSnap a worldwide, non-exclusive, royalty-free license to:

• Store, process, and transmit your Content to provide the Service
• Use anonymized and aggregated data to improve our AI models
• Display your Content to you and users you choose to share with

8. AI-Generated Content

8.1 Ownership of Generated Images

• You own the AI-transformed images created from your original photos
• NeonSnap does not claim ownership of AI-generated outputs
• You are responsible for how you use and distribute generated images

8.2 Limitations

• AI-generated content may not be perfect or meet your expectations
• Results depend on input quality and may vary
• We do not guarantee specific outcomes or quality levels

8.3 Commercial Use

Depending on your subscription plan, you may use AI-generated images for commercial purposes. Free tier users may have restrictions on commercial use.

9. Prohibited Activities

You must not engage in any of the following prohibited activities:

9.1 System Abuse

• Attempt to gain unauthorized access to our systems
• Introduce viruses, malware, or harmful code
• Overload or disrupt our servers or networks
• Circumvent security measures or usage limits

9.2 Content Violations

• Upload images depicting minors in inappropriate contexts
• Create non-consensual intimate images
• Generate hateful, violent, or terrorist content
• Produce content that violates export control laws

9.3 Service Misuse

• Use automated tools to access the Service (except with permission)
• Resell or redistribute our services without authorization
• Impersonate others or misrepresent your affiliation
• Interfere with other users' enjoyment of the Service

10. Service Availability

While we strive to provide reliable service, we cannot guarantee:

• Uninterrupted or error-free operation
• Compatibility with all devices or configurations
• Specific uptime percentages (except for Enterprise customers)
• Permanent availability of any specific feature

We reserve the right to perform maintenance, upgrades, and modifications that may temporarily affect Service availability.

11. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties regarding accuracy, reliability, or completeness
• Warranties that the Service will meet your requirements

We do not warrant that the Service will be error-free, secure, or free from viruses or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEONSNAP SHALL NOT BE LIABLE FOR:

12.1 Excluded Damages

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your account
• Damages resulting from third-party services or content

12.2 Liability Cap

Our total liability for any claims arising from or related to the Service shall not exceed the greater of:

• The amount you paid us in the 12 months before the claim arose, or
• $100 USD

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless NeonSnap, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your User Content or use of AI-generated content
• Your use or misuse of the Service

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through account settings
• Contacting our support team
• Ceasing to use the Service

14.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account has been inactive for an extended period
• We are required to do so by law

14.3 Effects of Termination

• Your right to access the Service will immediately cease
• Your User Content may be deleted (subject to our data retention policies)
• Fees paid are non-refundable except as required by law
• Provisions that by their nature should survive termination will remain in effect

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you via email or through a notice on the Service
• Provide a reasonable time period before the changes take effect

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
